For an islander driving home to Campobello, New Brunswick, buying a gallon of milk or a wheel of cheddar means crossing the international boundary into Lubec, Maine, and driving back across the Franklin Delano Roosevelt Bridge. On September 4, 2026, the Department of Finance made sure that grocery run did not trigger a trade war audit. Under Order in Council P.C. 2026-785, registered as the United States Surtax Order (2026) in the Canada Gazette, Cabinet matched a 50 percent U.S. tariff on $27.6 billion in Canadian exports with retaliatory surtaxes of 15, 25, and 50 percent across hundreds of American imports, while inserting a specific statutory shield in Section 2 to protect residents returning with personal groceries.
The island exception sits buried inside twenty-two pages of legal schedules and tariff line codes published in the September 23, 2026 issue of the Gazette. On paper, Canada was mobilizing its customs machinery for an unprecedented cross-border confrontation. In practice, the regulatory text reveals how quickly high-level retaliation collides with local geography, vulnerable domestic supply chains, and the everyday logistics of Canadian manufacturing.
The Section 338 Trigger
The confrontation began on July 20, 2026, when Washington issued three presidential proclamations under Section 338 of the United States Tariff Act of 1930. The statutory provision, an aggressive tool rarely deployed in modern trade, allows the American president to levy punitive duties of up to 50 percent against foreign countries accused of unreasonable or discriminatory commercial practices. The White House alleged that Canada maintained unfair barriers against American products in three specific sectors: automotive manufacturing, alcoholic beverages, and supply-managed dairy.
After a month-long standoff, the American duties took effect on August 22, 2026, slapping a flat 50 percent surtax across $27.6 billion worth of Canadian shipments entering the United States. Federal trade officials in Ottawa immediately moved to construct an equal response. The government committed to retaliate on a strict dollar-for-dollar basis, using executive powers under subsection 53(2) of the Customs Tariff to penalize imported American goods entering the Canadian market.
Transfer orders executed earlier under the Public Service Rearrangement and Transfer of Duties Act had already shifted authority over cross-border trade retaliation from the Minister of Foreign Affairs to the Minister of International Trade, and then directly to the newly designated Minister of State for U.S. Trade. Recommending jointly with the Minister of Finance, Cabinet authorized the new counter-surtax order on September 4, setting it to take effect four days later on September 8.
The stated federal objective was straightforward: exert maximum economic pressure on Washington to force the withdrawal of the Section 338 penalties, while creating strong financial incentives for Canadian importers to cut ties with American suppliers. Achieving that goal required categorizing American trade into three escalating tariff bands.
The Three Retaliatory Schedules
Under the United States Surtax Order (2026), imported American goods face punitive duties assessed directly against their value for duty under sections 47 to 55 of the Customs Act. These surtaxes apply on top of any regular customs duties already in force.
Schedule 1 establishes a 15 percent surtax on American industrial equipment and heavy tools. The target list ranges from metal-cutting tools and rock drills under heading 8207 to commercial air conditioners, industrial forklifts, ski-lift mechanisms, conveyor systems, and agricultural machinery like combine harvesters and mowers under heading 8433. Moulds used in automotive metal stamping and plastics manufacturing face the same 15 percent penalty.
Schedule 2 escalates the retaliation to 25 percent, aiming directly at American agriculture. The federal schedule hits dozens of distinct tariff lines covering dairy products, concentrating heavily on processed American cheeses under heading 0406. Everything from grated cheddar and processed cheese spreads to specialty blues and Italian varieties shipped from American creameries faces an immediate 25 percent border levy.
Schedule 3 applies the maximum 50 percent penalty to high-exposure American goods, directly mirroring Washington’s own 50 percent tariff level. The schedule targets American household appliances, pulp and paper products, and commercial electronics, ensuring that American manufacturers selling into Canada bear the exact cost imposed on Canadian exporters.
Yet behind the rigid numbers, federal officials were forced to confront immediate collateral damage at home.
The Fish Processing Retreat
When the Department of Finance published its initial retaliatory target list on August 25, 2026, it convened closed briefings with Canadian industry leaders, labour representatives, and food processors. The reaction inside the processing sector was swift. Canadian fish packing and processing plants, particularly in Atlantic Canada, rely on steady imports of raw, unprocessed fish and seafood caught by American vessels to keep their plant lines running at capacity before packaging and exporting the finished product.
Imposing a retaliatory tariff on American catch would not penalize Washington; it would bankrupt Canadian fish processing workers.
The regulatory impact analysis statement records the quiet retreat that followed. Based on feedback received during the closed consultation, the federal government made select adjustments to prevent wider economic damage, striking seafood and fish products off the counter-tariff list entirely before the order took legal effect. The primary record contains no public press release highlighting the reversal. The concession exists solely as a factual notation in the Canada Gazette, where the Department of Finance conceded that domestic processors could not absorb the blow.
The Campobello Grocery Corridor
The most telling regulatory carveout in the entire instrument addresses a single border crossing in Charlotte County, New Brunswick.
Campobello Island is geographically isolated. Connected by bridge only to Lubec, Maine, its roughly eight hundred residents have no direct year-round road connection to mainland New Brunswick. To buy groceries, pick up prescriptions, or conduct basic household shopping in Canadian stores, residents must cross the international bridge into Maine, drive northwest along American highways, and cross back into Canada at Saint Stephen.
Under the strict terms of Schedule 2, any Canadian returning with everyday groceries purchased in the United States, or even domestic dairy products brought back through the American transit route, risked being assessed a 25 percent surtax at the border.
Federal drafters addressed the anomaly directly in Section 2 of the order. Alongside routine exemptions for commercial goods already in transit before September 8, Cabinet inserted a precise statutory protection for the island. Under paragraph 2(c), goods are exempt from all surtaxes if they are imported at a port of entry on Campobello Island by a person who ordinarily resides on the island, who is returning after an absence from Canada of less than 24 hours, whose purchases form part of their personal baggage, and whose goods are strictly for personal or household use.
The islander returning with groceries from Lubec was legally insulated from the trade war raging across the rest of the continent.
Doubling Down on Steel and Aluminum
While Cabinet tailored the consumer and agricultural schedules in Order P.C. 2026-785, it used a second decree, Order in Council P.C. 2026-786, to escalate an older conflict.
In March 2025, Canada had responded to American Section 232 national security tariffs on metals by slapping 25 percent duties on American steel and aluminum imports under the United States Surtax Order (Steel and Aluminum 2025). When Washington subsequently doubled its metal penalties, Ottawa matched the move. Registered as SOR/2026-187, the amending order replaces the existing tariff schedules, driving the counter-tariff rate on American steel and aluminum products from 25 percent up to 50 percent.
The 50 percent hike spans eleven dense pages of tariff items in the Gazette. It hits basic hot-rolled sheet metal, alloy bars, wire rods, seamless casing, large-diameter pipeline steel under heading 7305, welded steel tubing, railway tracks, and structural beams under heading 7216. By raising the surtax to 50 percent, Canada matched the United States rate item for item across the metalworking economy.
Yet matching Washington rate for rate created a dangerous dilemma for domestic manufacturers who rely on specialized American raw materials that Canadian mills do not produce. To keep Canadian automotive plants, aerospace manufacturers, and food canneries from shutting down, Cabinet was forced to expand its administrative release valves.
The Ninety-Day Border Valve
Through consequential amendments embedded in the 2026 orders, the federal government extended its horizontal remission framework under the United States Surtax Remission Order (2025). Remission serves as a legal safety hatch under section 115 of the Customs Tariff, allowing the Minister of Finance to waive duties or refund money already paid when enforcing a tariff contradicts the broader public interest.
Under the amended framework, Canadian businesses that import American goods as inputs for manufacturing, processing, agricultural production, or food and beverage packaging can claim complete relief from the surtaxes. The relief period for American aluminum inputs was extended through July 1, 2027, while temporary relief for steel inputs was extended to February 1, 2026. Goods imported for public health, healthcare, public safety, and national security purposes remain fully exempt.
The regulatory statement acknowledges the administrative cost of running this double-sided system. While the surtaxes themselves are classified as taxes and therefore exempt from the federal one-for-one regulatory reduction rule, the process of claiming remission imposes real paperwork on Canadian businesses. To manage the burden, the Canada Border Services Agency committed to a formal 90-day service standard for processing refund claims, attempting to review customs documentation and return cash to domestic businesses within three months of submission.
Behind the political rhetoric of bilateral strength, the official record tells a more intricate story. The Canada Gazette confirms that running a modern trade war is not simply a matter of imposing tariffs. It is an administrative balancing act that requires calculating value for duty, managing multi-million-dollar remission dockets, carving out raw seafood to save domestic processing plants, and writing special border clauses so families on an isolated island can buy butter and cheese without paying for a dispute between Ottawa and Washington.

Thanks Mike, I had not realized that we had our very own equivalent to Point Roberts, WA. The article itself certainly shines a light on the complexities that are involved in a tariff war
Good article, Mike. I am happy that we have people knowledgeable about these necessary carveouts. Does Campobello Island have any marine links to New Brunswick?
